Terms of Service

1. General

These Terms of Service ("ToS") govern the relationship between the operator of CHOST.cz ("Provider") and the customer ("Customer") for hosting and related services.

By submitting an order or signing a service agreement, the Customer confirms they have read and agree to these ToS.

2. Services

Provider offers web hosting, game server hosting, and related managed services. Specific features and resource limits are defined by the selected plan.

3. Orders and contract formation

A contract is formed when the Provider sends an order confirmation email to the Customer. Provider reserves the right to decline any order without giving reasons.

4. Pricing and payment

Prices are listed on chost.cz. Provider may change prices with 30 days' notice to existing customers. Services are prepaid. Unpaid invoices may result in service suspension or termination.

5. Provider obligations

• Provide the service as described in the selected plan.
• Notify customers of planned maintenance in advance.
• Perform backups as included in the plan (backups are supplementary – Customer must maintain their own copies).
• Respond to security incidents without undue delay.

Provider is not liable for outages caused by third-party infrastructure, DDoS attacks exceeding protection capacity, or force majeure events.

6. Customer obligations

• Provide accurate billing and contact information.
• Not use the service for spam, malware, illegal content, or infringement of third-party rights.
• Maintain independent backups of their own data.
• Promptly notify Provider of security incidents or compromised credentials.

7. Acceptable Use Policy (AUP)

The following are prohibited on CHOST.cz infrastructure:

• Warez, cracking tools, illegally distributed software.
• Adult content without age verification.
• Phishing, malware, botnet command-and-control.
• Copyright-infringing content.
• Cryptocurrency mining without Provider's written consent.
• Anything unlawful under Czech law.

AUP violations entitle Provider to immediately suspend or delete the service without refund.

8. Uptime

Provider targets 99% monthly uptime on a best-effort basis. No formal SLA with penalties is offered.

9. Limitation of liability

Provider's liability for damages is limited to the monthly fee paid for the affected service. Provider is not liable for lost profits, data loss, or indirect damages.

10. Term and termination

Services run for the paid billing period. Customer may cancel at any time by email; prepaid fees are non-refundable unless otherwise agreed. Provider may terminate with 30 days' notice, or immediately for AUP violations.

11. Privacy

Processing of personal data is governed by the Privacy Policy.

12. Governing law and disputes

These ToS are governed by Czech law. Disputes shall be resolved by the competent court in the Provider's place of business. Consumers may use alternative dispute resolution through the Czech Trade Inspection Authority (ČOI).
